What selling costs, before the mortgage payoff

At a 5.5% total commission, on a single-family home, with a $700 settlement fee and no repair credits. Miami-Dade against Orange County — the difference is the title policy, which the buyer pays in Miami-Dade and the seller pays in Orange:

What Florida law fixes, and what it does not

Half this sheet is exact to the dollar and identical at every closing table in the state. The other half is negotiable, and knowing which is which is worth money.

  • Fixed by statute. Documentary stamps on the deed: $0.70 per $100 of price statewide, under chapter 201 of the Florida Statutes. Miami-Dade is the one exception — $0.60 per $100, plus a $0.45 surtax that does not apply to single-family residences. National calculators get this wrong constantly.
  • Fixed by rule. The owner's title insurance premium is promulgated by rule 69O-186.003: $5.75 per thousand to $100,000, $5.00 per thousand to $1 million, and less above that. Every title company charges the same premium. What differs is who pays it — the seller in 63 counties, the buyer in Miami-Dade, Broward, Sarasota and Collier.
  • Not fixed by anything. The commission and the settlement fee. Both are negotiated, and both have always been.
The tax question this page does not answer. If this was your primary residence and you lived in it two of the last five years, the first $250,000 of gain is excluded from federal capital gains tax — $500,000 filing jointly. If it was a rental, that exclusion does not apply and the depreciation you claimed is recaptured at up to 25%. And if you are not a U.S. person, FIRPTA withholding takes 15% of the sale price — not of the gain — at closing.

Where these numbers come from

Documentary stamps on the deed: chapter 201, Florida Statutes — $0.70 per $100 statewide; $0.60 per $100 in Miami-Dade plus a $0.45 surtax that does not apply to single-family residences. Owner's title insurance premium: rule 69O-186.003 of the Florida Administrative Code, which promulgates the rate — every title company charges the same. Who pays it is county custom, not law: the seller in 63 counties, the buyer in Miami-Dade, Broward, Sarasota and Collier. The $700 settlement fee is a reference figure, not a regulated one. Commission is negotiated.
