Every point is 1% of the sale price, which on a $500,000 home is $5,000 — the largest single line on the seller's closing statement by a wide margin, and the only large one that is negotiable.

What changed in August 2024

Following the settlement of antitrust litigation against the National Association of Realtors, an offer of compensation to the buyer's agent can no longer be published on the MLS. It can still be offered and negotiated between brokerages, and in practice it usually is — a seller who offers nothing is competing at a disadvantage. What also changed: a buyer now signs a written agreement with their agent before touring a home.

What did not change: commissions were always negotiable, and still are. No Florida law has ever set a rate.

What is actually negotiable

  • The rate, obviously — and the split between the listing side and the buyer's side separately.
  • A flat fee instead of a percentage. More common above $1 million, where a percentage stops correlating with the work.
  • A tiered structure, where the rate changes above a price you agree on.
  • The term of the listing agreement, and how you end it.
The percentage is not the whole cost. A rate one point lower that takes three months longer, or closes 4% under asking, is more expensive — and on a $500,000 home, 4% under is $20,000 against the $5,000 you saved. Florida's median time on market runs from about 43 days in Orlando and Tampa to about 82 in Fort Lauderdale. Ask what a lower rate is buying you, and what it is not.

Where these numbers come from

Commission is a straight percentage of the sale price — this arithmetic is exact. What is not exact is treating it as the only thing that comes out of your sale: the documentary stamps, the title policy, the settlement fee and your mortgage payoff are on the seller's closing sheet.
